Anti-Spam Policy

antispamSpam is unsolicited email.  It is also known as UCE (Unsolicited Commercial Email).  The Mid-Atlantic Hispanic Chamber of Commerce has a no-tolerance SPAM policy.  We follow industry-accepted,   permission-based email guidelines;  that is to say that we send email to those who by virtue of membership or by printed,  verbal or email means,  have requested to receive it.

In this day and age,  a dominant means of communication is via the Internet.  We send email messages to those who have a preexisting business relationship with us (our members and non-members who subscribe to our publications,  request information,  respond to a questionnaire or a survey,  or had offline contact with us)  and has consented to receive email messages from us.  We use products and services provided by our communications partner,  Constant Contact.  Every email we send through Constant Contact has an "Unsubscribe" link.  We will act on your request to be removed from our mailing list within three business days.

CAN-SPAM Act of 2003

The federal anti-spam law went into effect on January 1st, 2004 and preempts all state laws.  While this new law will not stop spam, it does make most spam illegal and ultimately, less attractive to spammers.  The law is specific about requirements to send commercial email and empowers the federal government to enforce the law.  The penalties can include a fine and/or imprisonment for up to 5 years.

  • Sender may not use false or misleading header information. The emails "From," "To," and routing information, including the originating domain name and email address, must be accurate and identify the person who initiated the email.
  • Sender may not use deceptive subject lines. The subject line cannot mislead the recipient about the contents or subject matter of the message.
  • Sender must provide a return email address or another Internet-based response mechanism that allows a recipient to ask you not to send future email messages to that email address, and you must honor the request.
  • The sender's  message must contain a clear and conspicuous notice that the message is an advertisement or solicitation and that the recipient can opt out of receiving more commercial email from you. It also must include your valid physical postal address.
  • Sender may not use "spam," "blast-faxes" or recorded telephone messages to market or sell products.

Constant Contact is our Communications Partner

After careful consideration and due diligence,   we chose to partner with Constant Contact because it is a leader in its field and offers a permission-based email-marketing tool that protects the MAHCC from sending SPAM inadvertently.  Constant Contact follows the strictest permission-based approach, which the MAHCC endorses in its entirety:

  • Communication - [Our] Constant Contact registration page already states why [we] are collecting the site visitor's email address, how [we] plan to use their address, and that [we] are following the embedded privacy policy. Additionally, by accepting Constant Contact license agreement [we] have agreed to use only permission-based lists and never to sell or rent [our] lists.
  • Verification - Constant Contact automatically sends all of [our] new contacts an email confirming their interest in receiving emails from us. Additionally, if [our] contact changes his or her interests or unsubscribes, Constant Contact automatically sends an email confirmation.
  • Unsubscribe - Every email generated from Constant Contact contains an unsubscribe link which allows [our] contacts to opt-out of future emails and automatically updates [our] contact lists to avoid the chance of sending unwanted emails to visitors who have unsubscribed.
  • Identification - [Our] email header information is correct because it is pre-set for [us] by Constant Contact. Our email's "From" address is verified and already accurately identifies [us] as the sender.
  • Contact Information - all of [our] emails are pre-filled with [our] contact information including [our] physical address.
